Entity: These Subscriber/App Terms are issued by SuperYears AI Pty Ltd, ABN 49 687 133 106, registered in Australia at Hampton, VIC 3188., Australia (“SuperYears”, “we”, “us”, “our”).
Channels: Subscriptions and in-app purchases may be offered via:
• Apple App Store
• Google Play Store
• Direct billing via our website (processed securely via Stripe)
Where you subscribe through a third-party platform (such as Apple or Google), billing, renewals, cancellations and refunds are governed by that platform’s terms and policies. Where you subscribe directly through our website, payments are processed via Stripe and are subject to these Terms.

SuperYears is a paid app that helps you plan and manage superannuation draw-downs. We share general guidance and education - not personal financial advice. If you need advice tailored to you, please speak with a licensed financial adviser.

What these Terms cover, in simple terms:

Plans & billing: you choose a plan and a billing period (monthly or annual). Prices and inclusions are shown in-app or on our site.

Free trials: if a trial is offered, we’ll show the price and billing period before it ends and ask for your consent before the first charge. You can cancel before the trial ends to avoid paying.

Auto-renewal & cancellations: subscriptions auto-renew unless cancelled. If you bought through Apple or Google, you must cancel in the App Store or Google Play; if you bought directly, you can cancel in the app’s Settings’ Subscription section. Access continues until your paid period ends.

Refunds & your rights: your Australian Consumer Law (ACL) rights still apply. App-store purchases follow Apple/Google refund processes; direct-billed refunds are handled by us as outlined in the Refunds section.

Fair use: don’t misuse the app (e.g., scraping, security interference, reselling access, or presenting our outputs as licensed advice).

Changes & availability: we improve the app over time. If we ever materially reduce core features of your paid plan, we’ll give reasonable notice and options. Outages and maintenance can happen.

Your data & privacy: your data is yours. We use it to run the app, keep things secure, and improve features. See our Privacy Policy and Accessibility & Data-Use Statement for how data is handled, stored, and exported.

Support: If you’re stuck, reach us at support@superyears.com.au during Monday to Friday, 9:00am–5:00pm AEST (excluding Australian public holidays). If you are unable to access your account or subscription, we will prioritise resolving the issue.

These Terms cover your use of the SuperYears subscription app (the Service). We provide general guidance about superannuation draw‑down management - not personal financial advice; if you need advice tailored to you, please speak with a licensed financial adviser. These Terms also cover plans & billing (including free trials and auto‑renewal), cancellation, ACL refunds, acceptable use, support, high‑level data handling, and our respective responsibilities.
This document sits alongside our Website Terms, Privacy Policy, Accessibility & Data‑Use Statement, Cookie Policy, Acceptable Use Policy (AUP), and (if applicable) a Data Processing Addendum (DPA).

1. Who we are & how these Terms work

These terms (the Terms) form a contract between SuperYears AI Pty Ltd, ABN 49 687 133 106 (SuperYears, we, us) and you. They govern your use of the Service and any related features we provide. If you buy via the Apple App Store or Google Play, their store terms also apply to purchases, renewals, and refunds for that channel. If you buy directly from us, our Direct Billing terms in §6 apply.

2. Key definitions

  • Billing Period: the recurring subscription interval (e.g., monthly/annual).
  • Channel: the storefront or payment route you used (App Store, Google Play, or Direct).
  • Plan: the subscription tier/features selected.
  • Major Failure / Consumer Guarantees: as defined under the Australian Consumer Law (ACL).
  • Service: the paid SuperYears app, features, and related support.

3. Eligibility, accounts & security

  • You must be 18+ and able to enter a binding contract.
  • Keep your login details confidential; you’re responsible for activity under your account. Tell us promptly about unauthorised use.
  • We may require identity/ownership verification to protect your account or comply with law.
  • Under‑18s: the Service is for adults. Self‑declared under‑18s must not purchase; public website content may be used read‑only (see Website Terms).

4. Plans, pricing, taxes & promotions

  • Plan details, features and prices are displayed in the app or on our website at the time of purchase. Prices are in Australian dollars (AUD) and include GST where applicable.
  • Promotions, credits, discounts or free trials may be subject to additional terms presented at the time of offer. Eligibility may be limited (for example, one trial per person, device, account, or payment method).
  • We may change plan features or pricing for future billing periods with reasonable notice. Any pricing changes will apply from the start of your next Billing Period unless required earlier by law.
  • Price-change notice: For annual subscriptions billed directly by us, we aim to provide at least 30 days’ notice before renewal where reasonably practicable.

5. Free trials, renewal notices & consent to first charge

  • If offered, free trials run for 7 days unless otherwise stated at the time of sign-up. Trials are available to new customers only, unless expressly stated otherwise.
  • Before the trial ends, we will clearly display the applicable subscription price, Billing Period, and renewal terms. By starting a free trial, you authorise us (or the relevant app store) to charge the applicable subscription fee at the end of the trial period unless you cancel before the trial ends.
  • You may cancel at any time before the trial ends to avoid the first charge. See the Cancellation section below for details.
  • For subscriptions purchased through Apple App Store or Google Play, renewal and billing are subject to the applicable app store terms and billing processes.

6. Billing channels (App Store, Google Play, Direct) & cancellations

  • Apple App Store: Subscriptions purchased via the Apple App Store automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription in your device settings: Settings ▸ Apple ID ▸ Subscriptions.
    If you purchased via Apple, contacting us will not cancel your subscription. You must cancel through your Apple App Store account. You can also manage subscriptions at: https://apps.apple.com/account/subscriptions

  • Google Play: Subscriptions purchased via Google Play automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription in Google Play: Profile ▸ Payments & subscriptions ▸ Subscriptions.
    If you purchased via Google Play, contacting us will not cancel your subscription. You must cancel through your Google Play account. You can also manage subscriptions at: https://play.google.com/store/account/subscriptions

  • Direct billing (website): If you subscribe directly through our website, you authorise us and our payment provider (Stripe) to charge your nominated payment method at the start of each Billing Period until you cancel.
    You may cancel at any time via your account settings in the app: Settings ▸ Subscription ▸ Manage subscription (or equivalent clearly labelled section).

  • Cancellation anytime: If you cancel, your access will continue until the end of the current paid Billing Period. We do not provide pro-rata refunds for unused time unless required by law. Nothing in this section limits your rights under the Australian Consumer Law.

  • Failed payments: If a payment fails, we may retry the charge. If payment remains unsuccessful, we may suspend or downgrade access after a 7-day grace period. Where reasonable, we will notify you before suspension.

  • Payment methods: For direct billing, we accept major credit and debit cards supported by Stripe. Payment processing is handled securely by Stripe.

  • Duplicate or unauthorised charges: If you believe you have been incorrectly charged, please contact support@superyears.com.au promptly so we can investigate and, where appropriate, reverse or credit the charge.

  • Clear renewals & easy cancellations: We display renewal terms and pricing clearly before purchase, provide advance notice for annual renewals where required, and offer simple, prominent cancellation pathways. We do not use deceptive or misleading cancellation practices.

7. Refunds & your ACL rights

  • Australian Consumer Law (ACL) preserved: Nothing in these Terms excludes, restricts or modifies your non-excludable rights under the Australian Consumer Law, including the Consumer Guarantees for services.

  • Major failure: If the service has a major failure under the ACL, you are entitled to the remedies available under the ACL. Where there is no major failure, we will provide remedies as required by law.

  • Store purchases: If you purchased your subscription via Apple App Store or Google Play, billing and refund processing are handled in accordance with that store’s policies and processes. Nothing in this section limits any rights you may have under the Australian Consumer Law.

  • Direct billing (website): For subscriptions purchased directly from us, refunds are not provided for change of mind, unused time, or failure to cancel before renewal, except where required by law or where we otherwise agree at our discretion.

  • **Material reduction of core features:**If, during your current Billing Period, we materially reduce the core paid features of your subscription plan in a way that materially impacts its value and you cancel as a result, we will provide an appropriate pro-rata refund or credit for the unused portion of that Billing Period (direct billing only).

8. What the Service is (guidance, not advice)

  • The Service provides general educational information and modelling tools about superannuation draw-down management. It does not take into account your objectives, financial situation, or needs.

  • We are not your financial adviser. Your use of the Service does not create a client–adviser, fiduciary, or professional services relationship. The Service does not recommend, issue, or arrange financial products, and does not provide personal financial advice.

  • Before acting on any information or projections generated by the Service, you should consider whether it is appropriate for your circumstances and seek advice from a licensed financial adviser where appropriate.

  • No guarantees: Outputs, projections and calculator results are estimates only. They rely on assumptions, user-provided inputs, and modelling methodologies that may change over time. Actual outcomes may differ materially from projections and may differ from superannuation fund statements, government assessments, or other official calculations.

  • We do not guarantee future performance, returns, eligibility outcomes, or regulatory treatment. For further information about assumptions, system limitations and data handling, see our Website Terms and Accessibility & Data-Use Statement.

9. Fair use & prohibited conduct

  • Don’t misuse the Service (e.g., unlawful acts, fraud, reverse engineering, scraping at scale, security interference, reselling access, or presenting outputs as licensed financial advice).
  • We may apply reasonable technical limits (e.g., request rates, storage caps, concurrent sessions) to keep the Service reliable.
  • Automation is only permitted via approved API keys/integrations where offered; browser automation of the UI is not allowed. See AUP.

10. Service changes, availability, maintenance & support

  • We may modify features, improve performance or security, or deprecate minor functionality from time to time.

  • If we materially reduce the core paid features of your active subscription plan during a Billing Period, we will provide reasonable notice and the options described in the Refunds section above.

  • Availability: We aim to maintain reliable access to the Service but do not guarantee uninterrupted, timely, secure or error-free operation. Scheduled maintenance and unplanned outages may occur.

  • Status & incidents: Where available, we publish service status updates at https://status.superyears.com.au (or a clearly linked status page on our website).

  • Support: You can contact support@superyears.com.au Our standard support hours are Monday to Friday (AEST), and we aim to respond within 1–2 business days. Issues affecting account access or subscription functionality are treated as high priority.

11. Beta/experimental features

From time to time, we may offer beta/experimental features. They are provided as‑is, may change or end at any time, and may not be covered by standard support or SLAs. You can opt out at any time.

12. Your content, data export & our IP

  • Ownership of your content: You retain ownership of content and information you submit to the Service. We do not claim ownership of your personal data or calculator inputs.

  • Licence to operate the Service: You grant us a limited, non-exclusive, royalty-free licence to use, process and store your content solely to operate, maintain, secure and improve the Service in accordance with these Terms and our Privacy Policy (for example, to compute results, provide support, prevent abuse, and maintain system integrity).

  • Access minimisation: Support access is role-based and logged. We access your workspace only where reasonably necessary to troubleshoot at your request, investigate suspected misuse, comply with law, or protect the security or integrity of the Service.

  • Aggregated & de-identified data: We may use aggregated and de-identified data to analyse usage patterns, improve features, enhance reliability, and develop new functionality. We take reasonable steps to prevent re-identification.

  • AI/ML use: We do not use your identifiable app content to train artificial intelligence or machine learning models without your explicit consent. We may use automated systems (including rules-based and machine-learning techniques) to operate, secure, and support the Service (for example, fraud prevention, abuse detection, and reliability monitoring), but not to train models on your identifiable app content without your consent.

  • Backups: Where immediate deletion is not feasible (for example, in immutable or encrypted backups), data is segregated and securely retained until deletion in accordance with our normal backup rotation processes.

  • Data export: You may request an export of your Personal Information, and selected account content where applicable, by emailing privacy@superyears.com.au. We will verify your identity and provide access within a reasonable period, typically within 30 days, unless a legal exception applies.

  • Where reasonably practicable, we will provide information in a structured, commonly used electronic format. We may withhold information where permitted or required by law (for example, where it would unreasonably impact the privacy of others or involve confidential or proprietary material).

  • Our intellectual property: We (and our licensors) own all intellectual property rights in the Service, including software, algorithms, models, content, branding and documentation. Subject to your compliance with these Terms and payment of applicable fees, you receive a personal, revocable, non-transferable, non-sublicensable licence to access and use the Service during your active subscription.

13. Privacy & data (summary)

  • We handle personal information in accordance with our Privacy Policy and explain calculator and data handling practices in our Accessibility & Data-Use Statement.

  • International transfers: If personal information is processed outside Australia, we apply appropriate safeguards in accordance with our Privacy Policy.

  • Security: We implement proportionate, risk-based security controls appropriate to the nature of the Service, including access controls and multi-factor authentication for privileged access, encryption in transit, logging and monitoring, and incident response processes.

14. Third‑party services, app stores & payment providers

  • The Service relies on third‑party services (hosting, analytics, payments, app stores). Their terms and privacy policies apply to their components.
  • App‑store purchases: Apple/Google are not parties to these Terms except as their conditions require; they may enforce their store terms.
  • Direct billing & ePayments Code (if applicable): if our payment provider subscribes to the ePayments Code, rules for unauthorised transactions/mistaken payments apply; disputes are handled under that Code and our T&Cs.
  • Third‑party links: we don’t control third‑party content; use at your own risk.

15. Suspension, termination & effects

  • You may cancel your subscription at any time in accordance with the Cancellation section above.

  • We may suspend or terminate your access to the Service if you materially breach these Terms, use the Service unlawfully, fail to pay fees after the applicable grace period, or where reasonably necessary to comply with law or protect the security or integrity of the Service.

  • On termination, your licence to use the Service ends and we may deactivate your account. We will retain or de-identify data in accordance with our Privacy Policy. You may request a data export before deactivation.

  • Post-termination access: For Direct billing subscriptions only, we will maintain a read-only access window of 14 days following termination to allow data export, unless suspension is due to unlawful use, security risks, or legal restrictions.

16. Liability, exclusions, cap & indemnity (ACL preserved)

  • ACL preserved: Nothing in these Terms excludes, restricts or modifies your non-excludable rights under the Australian Consumer Law.

  • Exclusion of indirect loss: To the extent permitted by law and subject to the ACL, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, business opportunity or data arising out of or in connection with the Service.

  • Liability cap: Subject to the ACL and to the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the Service is limited to the total fees you paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim.

  • Carve-outs: The exclusions and cap above do not apply to liability arising from fraud, wilful misconduct, or liability that cannot be excluded or limited by law.

  • Proportionate responsibility: You indemnify us against third-party claims and reasonable costs arising from your breach of these Terms or unlawful use of the Service, to the extent the loss is caused by your conduct. This indemnity does not require you to indemnify us for our own negligence, fraud or wilful misconduct.

17. Events outside our control (force majeure)

We’re not responsible for delay/failure caused by events beyond our reasonable control (e.g., internet/hosting outages, denial‑of‑service attacks, labour disputes, natural disasters, or changes in law). We’ll act reasonably to mitigate impacts and restore the Service.

18. Changes to these Terms

We may update these Terms; the Effective date will change. For material changes that adversely impact your paid Plan, we’ll give reasonable notice and, if required by law, options to cancel before the change takes effect.

  • Your right to cancel: if you don’t accept a material change that adversely affects you, you may cancel before the effective date. For Direct billing, we’ll provide a pro‑rata refund/credit for the unused portion.
  • We will not apply retroactive changes that reduce your rights for a period already paid.

19. Governing law, complaints & contact

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non‑exclusive jurisdiction of the Victorian courts and courts hearing appeals from them.

  • Notices: we may send notices electronically (email or in‑app). Keep your contact details current.

20. General (assignment, severability, waiver, interpretation)

  • You may not assign these Terms without our consent; we may assign to a successor in connection with a restructure, merger, or sale.
  • If any part of these Terms is invalid or unenforceable, the remainder stays in effect.
  • A delay/failure to exercise a right is not a waiver.
  • Headings are for convenience only and don’t affect interpretation.
