T‑1. Who we are & scope
- These Terms are between you and SuperYears AI PTY LTD; ABN 49 687 133 106. (SuperYears, we, us).
- They apply to the public website, content, and publicly accessible tools (the Site).
- If you use our subscription app/service, different terms apply - see the Subscriber/App Terms (link below).
T‑2. Acceptance & changes
- By using the Site, you accept these Terms. If you don’t agree, do not use the Site.
- We may update these Terms. For material changes, we will give at least 14 days’ notice via a banner on the Site and this page (except where the change is required for security or by law, in which case changes may take effect immediately).
- We will keep an archive of previous versions with dates. Your continued use after the notice period means you accept the changes.
T‑3. Eligibility & permitted use

The Site is intended for adults in Australia. You must be 18 years or older to create an account, subscribe to emails, submit content, or use interactive features.

Users aged 13–17 may browse the Site in a read-only manner. We do not knowingly collect personal information from children under 18 through interactive features. If we become aware that a child has provided personal information contrary to these Terms, we will take reasonable steps to delete it.

You must use the Site lawfully and only for its intended purpose. You must not attempt to breach security, access data without permission, interfere with the operation of the Site, or misuse any part of the Services.

T‑4. Guidance only (no financial product advice)
- Information on the Site is factual information and general guidance only. It does not consider your objectives, financial situation, or needs, and is not personal or general financial product advice.
- We are not your financial adviser; your use of the Site does not create a client–adviser relationship. Before acting, consider the information’s appropriateness and seek advice from a licensed financial adviser.
T‑5. Calculators & tools (assumptions, limits)
- Public calculators provide illustrative estimates using your inputs and assumptions shown on the tool, including government thresholds that change over time. Each calculator shows a version label and date‑stamped assumptions.
- Outputs are not predictions or guarantees and may differ from super fund statements or government assessments. Deterministic calculations may include rounding.
- Where shown, we present ranges (e.g., conservative/central/optimistic) to illustrate variability; these are scenarios, not advice.
- We process calculator inputs in memory and do not retain them unless you choose to save or export a scenario.
- Error logs may keep input snapshots for up to 7 years as per Australian Government data retention laws.
- Some calculations will be completed using values based on industry standards or averages. All data provided by calculations should be treated as general in nature.
- Use outputs as discussion starters with a licensed financial adviser - not as personal advice or guarantees.
- Before viewing results, you may be asked to acknowledge the above.
T‑6. Accounts, submissions & community features
- If the Site offers account sign‑up, newsletters, or submissions (e.g., feedback forms), you must provide accurate information and keep credentials secure (e.g., strong passwords or passwordless sign‑in).
- Your submissions: You are responsible for what you submit. Do not upload unlawful, infringing, defamatory, or harmful content. We may remove or decline content at our discretion.
- Licence for your content: You retain ownership of your content. You grant us a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, modify for moderation, and display that content on the Site and in materials that explain, operate, or improve the Site. This licence ends when your content is removed from the Site, except that reasonable archival/back‑ups may persist for compliance.
- Notice-and-takedown: If you believe content is defamatory, infringes IP, or violates privacy, please notify legal@superyears.com.au with details. We will assess promptly and remove or restrict access where appropriate.
T‑7. Intellectual property & user content licence
- We (or our licensors) own all intellectual property in the Site and its content. Trademarks referenced are the property of their respective owners.
- We grant you a personal, non‑exclusive, revocable licence to access the Site for lawful purposes. Do not copy, modify, distribute, reverse engineer, or create derivative works without our permission, except as allowed by law.
- The user content licence is described in T‑6.
T‑8. Third‑party links, summaries & affiliations
- The Site may include links to third-party or government websites. We do not control, endorse, or assume responsibility for their content, availability, or practices. You access third-party sites at your own risk and should review their terms and privacy policies.
- We may provide summaries of government rules, regulatory guidance, or public information for convenience. These summaries are general in nature and are not a substitute for official sources or professional advice. Always verify details using the linked primary sources. Content is date-stamped where appropriate and may not reflect later changes.
- From time to time, we may include referral or affiliate links. Where this occurs, we may receive a commission or other benefit if you choose to engage with the provider. This does not influence our editorial content, and any such links will be clearly identified where required.

- By providing contact details, you consent to receive notices and communications electronically (e.g., via the Site or email). You may withdraw consent by contacting us; withdrawal may affect access to certain features.
- Notices are deemed delivered when sent to your nominated email or posted on the Site and you have had a reasonable opportunity to view them. You must keep your contact details current.

- We aim to acknowledge accessibility requests within 5 business days and prioritise remediation based on severity and impact.

- Purchases via app stores: If you purchased through Apple or Google, cancellations and refunds are handled directly through the relevant app store and are subject to their terms and policies.

T‑13. Warranties, liability & Australian Consumer Law (ACL)
- The Site is provided “as is” and free of charge. We use commercially reasonable efforts to keep content accurate and the Site available, but we do not guarantee uninterrupted access or error‑free content.
- Nothing in these Terms excludes, restricts or modifies any non‑excludable consumer guarantees, rights or remedies under the ACL or any other law that cannot be excluded.
- To the extent permitted by law and subject to the ACL, we exclude all implied warranties and are not liable for indirect or consequential loss, loss of profits, or loss of data arising from your use of the Site.
- For claims not governed by non‑excludable rights, our aggregate liability for the Site is limited to AUD $100.
- We do not exclude liability for our negligence causing death or personal injury, fraud, or wilful misconduct where such exclusion would be unlawful.
T‑14. Indemnity
- You indemnify us against third-party claims, losses, damages, liabilities, and reasonable legal costs arising from your unlawful use of the Site, your breach of these Terms, or your infringement of third-party rights, except to the extent the loss is caused or contributed to by our negligence, fraud, or wilful misconduct. Your indemnity is limited to losses that are reasonably foreseeable and proportionate to your contribution to the relevant breach.
T‑15. Suspension/restriction of access
- We may suspend, restrict, or terminate access to the Site where reasonably necessary for maintenance, security, suspected misuse, breach of these Terms, or compliance with law.
- Where reasonable in the circumstances, we will provide notice of a suspected breach and an opportunity to respond before suspension. Immediate suspension may occur where security, safety, or legal risks require urgent action.
T‑16. Governing law & jurisdiction
- These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and courts hearing appeals from them.
- Nothing in this clause limits any non-excludable rights under mandatory consumer protection laws that apply to you.
T‑17. General (order of precedence, assignment, severability, waiver, interpretation)
- Order of precedence: These Website Terms apply to use of the Site. The Subscriber/App Terms apply to the app and subscription services. The Privacy Policy governs personal information handling. The Cookie Policy governs cookies and similar technologies. The Acceptable Use Policy (AUP) https://superyears.com.au/acceptable-use governs permitted conduct. The Complaints & Dispute Resolution Policy applies as stated within it. If there is any inconsistency, the document most specific to the subject matter prevails.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to a successor entity (including in connection with a merger, acquisition, or restructure) on notice to you.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- Waiver: A failure or delay in enforcing any right does not constitute a waiver of that right.
- Interpretation: Headings are for convenience only and do not affect interpretation.
